Law Day speakers discuss their national goals
‘ Make government liable, ’ says Bell McIntyre wants balanced budget

by Bell at the annual Law Day
ceremonies outside the Univer
sity School of Law. would
make the government liable
for attorney's fees if it files
suits against i • .

said if adopted the legislation

At a news conference after
his speech. Bell told reporters |
he was not sure w hen he would
leave office but he hoped it
would be* before the end of the
summer Bell said previously

“The object of our attorney's
fees legislative proposal would
be to give some fair measure
of redress to those persons but
without imposing a crippling
cost to the federal treasury or
chilling the vigor of federal
attorneys." Bell said
At his news conference Bell
said 25 percent of cases in
court today, including appelate
courts, are “groundless and
frivolous."
The proposal if approved
would only affect government
attorneys, but Bell said he
hopes the policy will "set an
example for the entire bar. and
will enhance credibility and
confidence in our legal system
“The Justice Department is
taking the lead in developing
these unusual approaches to
law practice problems because
it is our ethical duty lo do so.
and because the legal profes
sion requires improvement."
Bell stated
The basic problem Bell sees
in the legal system is that
"both government and law as
reflected in government regu
lation and litigation are close
to losing sight of a very basic
goal—fundamental fairness.
"It is equally important that
we approach federal criminal
prosecutions with the same
sense of fundamental fair
ness,” Bell said.
“The Attorney General's
policy directive that we are
drafting will also ensure that
no indictments are recom
mended by a federal prosecu
tor unless the evidence pre
sented to a grand jury would
be at least likely to produce a
conviction," Bell said.

The federal budget will be
balanced in two years if the
economy keeps growing, ac
cording to James T. McIntyre,
director of the federal Office of
Management and Budget
"I think it can be done in the
next two years—if we don't
have a recession." said Mcln-
tyrt, it IMS University law
school graduate and native of
Vidalia
Speaking before a luncheon
of the Law School Association
at the Georgia Center for
Continuing Education Satur
day. McIntyre said the OMB is
now one of the most important
institutions in government as it
affects foreign and domestic
policy.
In addition to its normal
roles. OMB is responsible for
President Carter's reorganiza
tion of the federal government.
"OMB is the mainspring of a
watch; the heartbeat of the
federal government.” McIntyre
said.
Although OMB has several
goals including cutting down
on official red tape and making
government officials account
for their actions, balancing the
budget is its most important
goal, McIntyre said
"Reducing federal spending
is. in m> judgement absolute
ly essential. National economic
discipline is also needed." he
said.
However, many constraints
exist that will make balancing
the budget more difficult.
McIntyre added.
A large amount of the
federal budget is beyond the
reach of the normal process of

The senate also adopted other changes to the A&S bylaws, but
the section concerning the selection of new department heads
drew most of the debate.
A large part of the debate concerned the definition of who is a
faculty member, with some senators pushing for instructors and
visiting professors to be included.
The inclusion of people from the two categories was seen as a
way to allow for more participation by women and minority
faculty on search committees, according to senators who
participated in the debate.

McIntyre said "Approximate
ly $51.2 billion is civilian
outlay—less than 10 percent."
Many federal programs that
that cannot be changed by Con
gressional review place an

the federal budget.
“Many federal programs
have a sacred cow aspect that
render them uncontrollable."
McIntyre said
He cited programs such as
Medicare. Medicaid and food
stamps as examples Making
such programs controllable is
absolutely essential, he added.
Performance of the economy
acts as another constraint,
according to McIntyre.
A higher cost of living drives
up the deficit and inflation
may have good effects by
raising revenues, but it also
runs people into a higher tax
bracket, he added.
"Without cuts in federal
spending, the results are a
higher deficit." McIntyre said
A third constraint on balanc
ing the budget is political
pressure, he said.
"One man’s waste is another
man's entitlement” And,
though many people feel a cut
in federal programs is neces
sary. when it’s their program
they are not as certain,
McIntyre said.

Fund, was slated to be cut. he
said. But the beekeepers felt so
strongly about it they attempt

necessary to the economy

Although the battle isn't over
yet. "the beekeepers will
probably win." McIntyre said.
"While we can get a clear
consensus on the general
principle to balance the federal
budget, the general principle
gets corroded when personal
interest gets involved,” he
said.
The government and the
public should keep the goal in
mind and continue to tackle
balancing the budget without
letting up. McIntyre added.
Lawyers are necessary for
this effort because they are
economic strategists and advo
cates for the people, he said.
"But. in the field of
economics, lawyers should not
lose sight that the party at
interest is the public taxpay
er." McIntyre said.
"Higher economic discipline
is a major step in helping to
bridge the gap between the
rhetoric of a balanced budget
and the realities of getting
there." he said.
